Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the bebubeds.com website (the “Service”) operated by Bebu OÜ (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of Bebu OÜ and its licensors.

Our Service may contain links to third-party web sites or services that are not owned or controlled by Bebu OÜ.

Bebu OÜ has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Bebu OÜ shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. Governing Law

These Terms shall be governed and construed in accordance with the laws of Estonia without regard to its conflict of law provisions.

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

To fulfill your order on the bebubeds.com online system we need your name, mailing, billing and/or shipping addresses, telephone number, e-mail address. Bebubeds.com uses this information that you provide to ship your orders, service your account, personalize your experience and to communicate with you.

OÜ Bebu is the controller of personal data, OÜ Bebu transmits personal data necessary for making payments to the authorized processor Montonio Finance OÜ.

What personal data is being processed

  • name, phone number and e-mail address,
  • delivery address;
  • bank account number;
  • cost of goods and services and payment data (purchase history); – Customer support information.

The purpose for which personal data are processed

Personal information is requested to manage customer orders and deliver goods.
Purchase history data (date of purchase, merchandise, volumes, customer details) must be prepared and compiled for customer service personnel.
The bank account number requires the customer to withdraw the payments.
Personal information such as email, phone numbers, customer name, job search process, and provision of customer service related to the service.
The actual use of the web store user IP address or other web store processing the online identifiers as an information society service and web usage statistics.

Legal basis

Personal data are processed for the purpose of executing the contract with the client.
The processing of personal data takes place in order to fulfill a legal obligation (eg accounting and settlement of consumer disputes).
Personal information is passed to the online store customer support to manage purchases and purchase history, and to resolve customer issues.
The name, phone number and e-mail address will be forwarded to the transportation provider of your choice. In the case of goods delivered by courier, the address of the customer shall be provided in addition to the contact details.
If the online store is accounted for by a service provider, personal data will be transferred to the service provider for accounting purposes.
Personal information may be transferred to information technology service providers if this is necessary to ensure the functionality of the web store or data hosting.

Security and data access

Personal data is stored on servers located in the territory of a Member State of the European Union or countries that are members of the European Economic Area. Data may be transferred to countries that have been assessed by the European Commission as having an adequate level of data protection and to US companies that are affiliated with the Privacy Shield framework.
Access to personal information is available to online store staff who can access personal information to resolve technical issues related to the use of the online store and to provide customer support.
The Web Store implements appropriate physical, organizational and IT security measures to protect personal information from accidental or unlawful destruction, loss, alteration or unauthorized access and disclosure.
The transfer of personal data to authorized processors of the web store (eg transport service provider and data hosting) is subject to agreements with the web store and the authorized processors. Controllers are required to provide appropriate safeguards for the processing of personal data.

Data Enhancement

In our effort to continually be a better, more efficient and more effective company and to help ensure that we are being as relevant to you as we can, we occasionally add other public information about you from other sources to the data we house. To do this may involve sharing some minimal data (generally only name, address and/or phone) for matching purposes.

Access and rectification of personal data

Personal Data can be accessed and corrected in the online store user profile. If the purchase is made without a user account, personal information can be accessed through customer support.

Withdrawal of consent

If the processing of personal data takes place with the consent of the customer, the customer has the right to withdraw the consent by notifying the customer support by e-mail.

Retaining

Closing an online store customer account will delete personal information unless such data is required to be stored for accounting or consumer dispute resolution purposes.
If a purchase is made without a client account in the online store, the purchase history is retained for three years.
In the case of disputes relating to payments and consumer disputes, personal data shall be retained until the claim has been complied with or until the limitation period has expired.
The personal data necessary for accounting purposes shall be kept for seven years.

Deletion

Contact customer support via email to delete your personal information. The request for erasure shall be replied to within not more than one month and the period for erasure shall be specified.

Transfer

Requests for the transfer of personal data sent by e-mail shall be answered within one month at most. Customer Support identifies and informs you of personal data that is subject to transfer.
Direct Marketing Messages The email address and telephone number will be used to send direct marketing communications, subject to customer consent. If the customer does not wish to receive direct marketing notices, either select the appropriate reference in the footer of the email or contact customer support.
If personal data are processed for direct marketing purposes (profiling), the customer is entitled to a profile analysis of both the initial and further processing of their personal data, including direct marketing
object at any time by notifying customer support via email (such information must be clearly and separately from any other information).

Solving arguments

Disputes related to the processing of personal data are resolved through customer support. The supervisory authority is the Estonian Data Protection Inspectorate (info@aki.ee).

Shipping, returns, right

The owner of the online store bebubeds.com (hereinafter referred to as the online store) is OÜ Bebu (registry code 14926497), located at Haavatuka, Põlma village, Rapla district, Rapla county 78410 Estonia. E-mail- support@bebubeds.com.

 

Validity of contract of sale, product and price information

The conditions of sale apply to purchases of goods from the online store.

The prices of the products sold in the online store are indicated next to the products. Shipping is included into that price and does not depend on location, as long as it is within European Union countries Norway and UK (United Kingdom). Transactions shall be settled in euros- EUR (€).

Product information is provided immediately adjacent to the product in the online store.

 

Placing an order

Add the desired products to your shopping basket to order them. Fill in all of the required fields and choose the most suitable shipping method to complete the order. The total cost is then displayed on the screen. This can be paid via choosing the payment method below.

The contract enters into force when the amount payable is transferred to the bank account of the online store.

If we cannot deliver the ordered goods due to stock running out or for any other reason, the purchaser will be informed as soon as possible and the money paid will be refunded promptly, but no later than within 14 days of receiving the notification.

 

Shipment

Goods are shipped to the following countries: European Union countries Norway and UK (United Kingdom).

For all other destinations– please contact us via e-mail (support@bebubeds.com) and we will calculate the shipping price with our delivery partners, if we agree on final cost, then will send you a bill accordingly.

All shipments are guaranteed to arrive within 14 calendar days for European Union countries Norway and UK (United Kingdom). We have the right to ship goods in up to 45 calendar days in exceptional cases.

For all other destinations- we have the right to ship goods in up to 45 calendar days.

We will provide you a tracking code to monitor its logistics.

 

Right of withdrawal

After receiving the order, the purchaser has the right to withdraw from the contract entered into with the e-store within 14 days. (Depending on the product, the purchaser may not necessarily have the right of withdrawal; in such a case the corresponding products and services must be listed and they must comply with the conditions provided for in subsection 53(4) in the Law of Obligations Act.)

The right of withdrawal does not apply if the purchaser is a legal person.

To exercise the 14-day right of withdrawal, you must not use the ordered goods in any way other than is necessary to ensure the nature, characteristics and functioning of the goods in the same way you would be allowed to test the goods in an actual store.

If the goods have been used for any purpose other than is necessary to ensure the nature, characteristics and functioning of the goods, or if there are any signs of use or wear and tear, the online store has the right to lower the amount returned in accordance with the decrease in the value of the goods.

To return the goods, you must submit a declaration of withdrawal (the form for which can be found here: declaration of withdrawal) to the e-mail address support@bebubeds.com within 14 days of receiving the goods.

The purchaser shall bear the cost of returning the goods, except in cases where the reason for the return lies in the fact that a refundable product does not comply with the order (e.g. a wrong or defective product).

The purchaser must return the goods within 14 days of the submission of the declaration of withdrawal or submit evidence that they handed over the goods to the carrier within the aforementioned period.

Upon receiving the returned goods, the online store shall return to the purchaser, immediately but no later than after 14 days, all of the payments received from the purchaser based on the contract.

The online store has the right to refuse to make the refund until the goods being returned are received or until the buyer has provided proof of returning the products, whichever occurs first.

If the buyer has clearly chosen a different form of shipment than the cheapest usual form of shipment offered by the online store, the store is not required to compensate the cost exceeding the usual shipping cost.

The online store has the right to withdraw from the sale and demand that the goods be returned by the purchaser if the marked price of the goods in the online store is significantly lower than the market price of the goods due to an error.

Defective goods

The online store is responsible for the non-compliance of goods sold to a purchaser with the terms and conditions of the contract or for deficiencies which already existed at the time of delivery and which occur within two years of delivering the goods to the purchaser. Within the first six months of delivery it is assumed that the defect was present at the time of delivery. It is the online store´s responsibility to prove otherwise.
The purchaser has the right to turn to the online store within two months of the occurrence of a defect by e-mailing support@bebubeds.com.The online store is not liable for any defects arising after delivering the goods to the purchaser.

If goods bought from the online store have defects for which the online store is responsible, the online store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the online store shall return to the purchaser all of the payments involved in the contract of sale. The online store will respond to the consumer´s complaint in written form or in a form that enables written reproduction within 15 days.

Direct marketing

The online store sends newsletters and offers to the purchaser’s e-mail address only if the purchaser has expressed their wish to receive them by entering their e-mail address on the website and indicating their desire to receive direct mail.
The purchaser is able to opt out of offers and newsletters sent to their e-mail address at any time by letting us know via e-mail or by following the instructions in an e-mail containing an offer.

Settlement of disputes

All complaints made by a purchaser about the online store must be e-mailed to support@bebubeds.com.
If the purchaser and the online store are not able to settle the dispute by agreement, the purchaser may contact the Consumer Dispute Committee. You can review the procedural rules and submit a complaint here. The Consumer Dispute Committee is competent to resolve disputes arising from a contract between a purchaser and the online store. Resolution of disputes by the Consumer Dispute Committee is free of charge for the purchaser.A purchaser may also turn to the dispute resolution bodies of the European Union.
